La Suprema Corte de Justicia de Estados Unidos escuchó este martes los argumentos orales para determinar si debe ser revocada una ley federal que penaliza a cualquier persona que aliente a un extranjero a venir, entrar o permanecer en el país sin documentos migratorios.
Si la mayoría de los magistrados votan a favor de mantener la ley, el impacto podría ser devastador y de gran alcance, ya que los consejos legales, las declaraciones o las publicaciones por escrito de abogados, activistas y defensores de los inmigrantes podrían ser delitos.
El caso que analiza la Suprema Corte es el de Evelyn Sineneng-Smith, quien a través de un negocio de consultoría de inmigración en California prometía a sus clientes -principalmente inmigrantes filipinos trabajadores en el sector de la salud- un estatus migratorio legal mediante un programa de certificación laboral.
A pesar de que sabía que sus clientes no eran elegibles para el programa, Sineneng-Smith amasó una millonaria fortuna durante los 7 años que estuvo cobrando fuertes sumas de dinero por sus honorarios legales, hasta que en el 2010 fue arrestada y procesada por fraude postal, entre otros cargos.
Entre esos otros cargos de los que fue encontrada culpable, está el delito de “alentar a la inmigración no autorizada” que se enmarca en la Sección 1324 del USC 8 de la Ley de Reforma y Control de Inmigración (IRCA), promulgada en 1986.
El estatuto indica: “Cualquier persona que aliente o induzca a un extranjero a venir, ingresar o residir en Estados Unidos, sabiendo o sin importarle que tal ingreso o residencia es o será una violación de la ley, será castigado según lo dispuesto”.
La sección del código penal fue anulada por la Corte de Apelaciones del Noveno Circuito al indicar que era demasiado amplia y atentaba a la libertad de expresión que establece la Primera Enmienda de la Constitución.
Ese fallo judicial precisa que la ley penalizaría conversaciones y consejos legales que ocurren a diario y que están protegidos constitucionalmente, y puso como ejemplos de conductas que podrían ser delictivas bajo esa norma:
- Una abuela amorosa que insta a su nieto a quedarse más tiempo de lo que indica su visa.
- Publicar en redes sociales mensajes que alientan a los indocumentados a permanecer en Estados Unidos.
- Un abogado que le dice a su cliente que no acepte irse del país mientras pelea su deportación.
A principios de febrero un tribunal federal en Arizona exoneró a cuatro mujeres activistas de la organización No More Deaths que habían sido sentenciadas por la administración del presidente Donald Trump bajo ese estatuto, acusadas de alentar los indocumentados a ingresar al país al dejarles agua y comida en una zona desértica por donde suelen cruzar la frontera de México a Estados Unidos.
La jueza del tribunal dictaminó que las activistas no habían violado la ley porque las acciones eran en el ejercicio de sus creencias religiosas.
